CIC holds DAV College, Chandigarh guilty of violating RTI Act

Central Information Commission, New Delhi has held the Principal of
DAV College, Chandigarh guilty of deliberately depriving the applicant
information for a period of over 20 months and defeating the very
purpose for which this Act has been legislated by the Parliament.
Accepting the appeal in toto, the Principal has been directed to
provide the complete and categorical information issue-wise on all the
10 issues raised by the applicant.


RTI Activist Dr Rajinder K Singla had on September 17, 2014 sought
details of the Assistant Professors appointed on contract in this
college for the academic session 2014-15, their pay-scales,
appointment orders, proceedings of the scrutiny and selection
committees, comparative biodata of the candidates interviewed, their
status of approval by the affiliating Panjab University and the
advertisement published in the newspaper(s) vide which applications
were invited for these vacancies. Besides, the Principal was requested
to disclose their service conditions, if they were governed by the
conditions other than those prescribed in Panjab University Calendar
for regular Assistant Professors. On October 10, 2014, Principal Dr BC
Josan denied entire information stating it to be varied, voluminous,
pertaining to third party, having no public interest and adversely
impacting the functioning of the college. Instead of providing
information, Principal asked the applicant to visit his office and
inspect documents. On November 10, 2014, Aggrieved Dr Singla filed
first appeal before the Director Higher Education, Chandigarh
Administration. Appellant duly argued and rebutted the statements made
by the Principal in December 2014, but the Appellate Authority failed
to deliver his decision. Aggrieved Dr Singla finally approached the
Information Commission, both against the CPIO Dr BC Josan and the
Appellate Authority, where this matter was heard on June 7, 2016.

Information Commissioner MA Khan Yusufi quashed and set aside the
orders of both, the CPIO as well as Appellate Authority, holding the
same to be not legally tenable. The commission has held that as per
the provisions of the RTI Act, the right to inspect or not to inspect
the documents is vested in the applicant and insistence of a public
authority for inspection of relevant record is not legally tenable.
Since the appellant had not requested for inspection of relevant
records, the college was thus under legal obligation to provide the
required information. Holding that the information seeker has been
deliberately deprived from having the benefits of the RTI Act, the
College Principal has been directed to provide him the complete
information within 30 days.

केंद्रीय सूचना आयोग ने चंडीगढ़ के डीएवी कालेज को ठहराया आरटीआई कानून की
उलंघना का दोषी.

हाल ही में दिए अपने एक फैसले में केंद्रीय सूचना आयोग, नई दिल्ली ने
चंडीगढ़ के डीएवी कालेज को 20 महीने गुजर जाने पर भी सूचना न देने का दोषी
ठहराते हुए कहा है कि प्रिंसिपल व् सूचना अधिकारी ने उस उदेश्य की ही
उलंघना की है जिसके लिए यह कानून बनाया गया था. आवेदक की याचिका को पूरी
तरह मंज़ूर करते हुए सूचना आयुक्त ने कालेज प्रिंसिपल को आदेश दिए हैं कि
वह 30 दिन के अन्दर आवेदक को विषय-अनुसार पूरी सूचना मुहैया करवाए.

चंडीगढ़ के आरटीआई कार्यकर्ता डा राजिंदर के सिंगला ने 17 सितम्बर 2014
को एक आवेदन दाल कर डीएवी कालेज के प्रिंसिपल से पूछा था कि उन्हें सत्र
2014-15 में कॉन्ट्रैक्ट पर रखे असिस्टेंट प्रोफेसरज का व्योरा देते हुए
उनके पे-स्केल, नियुक्ति-पत्र, स्क्रीनिंग व् चयन कमेटी की सिफराशें,
पंजाब विश्वविद्यालय द्वारा उन नियुक्तिओं का अनुमोदन तथा समाचार पत्र
में छपा वह विज्ञापन दिया जाये जिसके तहत यह नियुक्तिया की गयी थी. अगर
उनकी सर्विस की शर्तें विश्व विद्यालय कैलेंडर में स्थाई अधिआप्कों के
लिए निर्धारत शर्तों से अलग हैं तो भी दिखाई जाएँ. कालेज प्रिंसिपल ने 10
अक्टूबर 2014 को कुछ भी बताने से इंकार करते हुए कहा कि मांगी गयी
जानकारी बहुत ज्यादा है, किसी तीसरे व्यक्ति से सम्बंधित है, इसमें कोई
पब्लिक इंटरेस्ट नहीं है तथा ऐसी जानकारी देने से कालेज को चलाने में
बाधा पड़ती है. अगर आवेदक चाहे तो उबके दफ्तर में आ कर रिकॉर्ड देख सकता
है. डॉ सिंगला ने सूचना अधिकारी के इस निर्णय के खिलाफ चंडीगढ़ के उच्च
शिक्षा निदेशक को पहली याचिका दायर कर इन्साफ की मांग की पर कोई फायदा
नहीं हुआ, जिसके चलते उन्हें केंद्रीय सूचना आयोग का दरवाज़ा खटखटाना पड़ा
जहाँ 7 जून को इस मामले की सुनवाई हुई.

सूचना आयुक्त एम्. ए. खान युसुफी ने कालेज प्रिंसिपल व् उच्च शिक्षा
निदेशक दोनों के फैसलों को कानूनी तौर पर गलत ठहराते हुए रद्द कर दिया.
सूचना आयुक्त ने कहा कि पूरे मामले में आरटीआई कानून की घोर उलंघना हुई.
दस्तावेजों का निरक्षण करना या न करना आवेदक का हक है न कि सूचना अधिकारी
द्वारा इसे थोपा जा सकता है. क्योंकि आवेदक ने निरिक्षण की कोई मांग ही
नहीं की है, इसलिए उन्हें निरिक्षण के लिए अपने दफ्तर बुलाना सरासर गलत
है. साथ ही कालेज प्रिंसिपल को निर्देश दिए गये हैं कि आगामी 30 दिन के
भीतर आवेदक को पूरी जानकारी मुहैया करवाई जाए.
