कोर्ट ने लोकपाल और लोकायुक्त एक्ट 2013 की धारा 44 के प्रावधानों को प्रस्तुत करते हुए कहा कि सभी कर्मियों को अपने, अपनी पत्नी तथा परिवार के सदस्यों के संपत्ति विवरण प्रत्येक साल के 31 जुलाई तक अवश्य ही दायर करने हैं, अतः सरकार यह बताये कि उसके द्वारा तारीख किस आधार पर बढ़ाई गयी. अमिताभ ने अपनी याचिका में कहा था कि अब तक वर्ष 2013-14 के विवरण हेतु 6 बार और 2014-15 के विवरण हेतु 3 बार तारीख बढ़ चुकी है और हाल में यह 12 अप्रैल 2016 को फिर से बढ़ाया गया है.
HC : Does Govt have right to extend property return dates for babus?
The Lucknow bench of Allahabad High Court today asked the Government of India to clarify within 04 weeks whether it has powers to extend or relax the date for submission of property returns of central government employees, including IAS and IPS officers. The bench consisting of Chief Justice Dr Dhananjay Yashwant Chandrachud and Justice Rajan Roy passed in this order in the petition filed by IPS officer Amitabh Thakur which said that the last date for filing property returns is being extended again and again.
Quoting the various provisions of section 44 of the Lokpal and Lokayukta Act 2013, the Court said every public servant is supposed to provide the property returns of himself along with his spouse and family members by 31st July every year, it asked the Central government to explain on what basis it extended the last date of submission. Amitabh had said that the last date for 2013-14 has been extended 6 times and that for 2014-15 has been extended 3 times and recently it was extended once again on 12 April 2016, which is improper.
